CCTV to Prevent, Detect and Prosecute Breaches of the Waste Management and Litter Pollution Acts: Toppins Field

Limerick City and County Council (LCCC) intend to install CCTV for the sole purpose of preventing litter and illegal dumping and to enforce the Litter Pollution Act 1997 and the Waste Management Act 1996. This initiative will adhere to the Codes of Practice for the Operation of CCTV for the Purposes of Prevention, Detection and Prosecution of Litter and Waste Offences. This action is being taken in accordance with Aim 3.2 of the LCCC Litter Management Plan 2023-2026.

CCTV for waste and litter enforcement will only be used where it is justifiable and proportionate to do so and where there is evidence of persistent littering and/or illegal dumping. This public consultation provides an opportunity for individuals and businesses to comment on how CCTV Schemes for litter and waste enforcement may affect their lives.

The Council are seeking your views on the installation of a new CCTV scheme for the purpose of enforcement under the Waste and Litter Acts at the following site.

Existing/NEW

In Toppins field, three existing cameras are currently in operation. These cameras have been sanctioned under the Garda Síochána Act 2005 and are subject to live monitoring. Personnel undertaking live monitoring have been non act Garda vetted and appropriately trained.

In relation to these cameras, the Council’s Enforcement Officers have powers under Section 41B to request access to recorded footage for the purposes of waste and litter enforcement. These cameras have now been designated as dual-purpose, meaning they are also sanctioned for use under the Circular Economy and Miscellaneous Provisions Act 2022. 

Footage from the NEW cameras will only be requested where an offence under the Waste or Litter Acts may have been committed. The proposed new cameras will not be live monitored. Recordings will be retained for up to 28 days before being overwritten. The cameras will record footage that may be used as evidence for enforcement proceedings under the Waste and Litter Acts. Footage will not be used for any purposes other than those outlined in the legislation below;
