Details below of the recent provision under Section 28 of the Planning and Development (Amendment) Act 2025 for extensions of duration for un-commenced residential permissions.
- This provision relates to un-commenced residential development of one or more houses and a maximum of 3 years extension of the permission can be applied for.
- There are strict timeframes which require that an application can only be made within 2 years of the expiry date of the permission and must be made within 6 months of the commencement of the Act i.e. between 1st August 2025 and 31st January 2026.
- Any development granted an extension under this provision must commence within 18 months of the commencement of the Act i.e. by 31st January 2027.
- A further extension may be granted where the development is substantially completed by the extended expiration date, up to a maximum of 5 years in total (i.e. for both extensions).
